Terms & Conditions

DK is a registered employment agency. As required by the Department of Business, Energy and Industrial Strategy (BEIS) regulations, the Agent’s booking confirmation form, containing the specific terms of the booking, must be signed and returned by the client. The failure to sign and/or return the booking confirmation form whilst proceeding with the booking will be deemed to be an acceptance by the client of these terms and conditions and they shall apply to and govern the booking between the Agent and the client.

Any model introduced to a client by DK may only be booked through DK and may not be contacted directly by the client. DK reserves the right to invoice the client any fees to cover all losses incurred in the event of this.

FEES

All fees are to be negotiated only with DK

It is not permitted for any person or company to use photographs or footage for any purpose whatsoever until all fees have been paid to DK in full.

On all invoices payment is required within 30 days of the date of invoice.

In all cases the person booking the model will be invoiced and solely responsible for payment, unless otherwise agreed in writing at the time of booking. In the case of non-payment by the person booking the model, DK reserves the right to invoice the ‘ultimate client’ (i.e. designer/manufacturer/owner of the product in question). The client should notify all parties affected by this clause as no usage of photographs or footage is permitted by any person or company until all fees have been paid to DK in full. 

If fees are invoiced to a client with an address outside the UK, any bank charges must be covered by the client. The full amount stated on the invoice must be credited to the DK bank account.

All fees are based on an 8-hour day (excluding Equity contracts) including a 1 hour lunch break

Models may be booked for a full day, a half-day or hourly (2 hour minimum). Extra half hours or parts of hours will be charged at the hourly rate. Expenses will be added where appropriate.

Normal rates apply to bookings between 9a.m. and 6p.m. Monday to Friday. Outside these times overtime is applicable. Please enquire for rates.

USAGE

Unless otherwise agreed, in writing, the permitted use for photographs is for editorial, press advertising or brochures and excludes posters, website, billboards,  packaging, display material , (showcards, point of sale, swing tickets, posters, bus sides etc. CD, video and DVD covers and stills in commercials). An additional rate is payable for each of the above categories. The client is responsible for negotiating the additional fees for each of these categories before use can commence. 

WEATHER PERMITTING BOOKINGS

First cancellation no fee- unless model arrives at booking through a client’s failure to cancel in time.

Second cancellation – half fee.

CHILDRENS LICENCES

Every client is required, by law, to licence all children under 16 years for every job that they are booked for. The client should be aware that if a valid licence is not in place the penalties can be a fine of up to £1000 and/or a prison sentence of up to 3 months.  Children without a licence in place are not insured or protected and therefore, if an accident occurred the full responsibility would lie with the client. If required the agency can process a licence on the client’s behalf and this would incur a fee of £15 per licence.

A licence can only be granted by the child’s Local Education Authority (LEA). . It is vital to contact DK and confirm the current licensing status of any child being considered for a photographic booking.

DK will provide the necessary paperwork and guidance but ultimate responsibility for issuing the licence lies with the child’s LEA

CANCELLATIONS

If a booking is cancelled within one working day of the starting time, full fee is charged. If a booking is cancelled outside the one day period, but within two working days of the start time then a half fee will be charged.

Should a booking be cancelled due to illness or other reasons beyond the models or agents control neither the model nor the agent shall be responsible for cancellation charges.

COMPLAINTS

Any cause for complaint should be reported when it arises to the agency. Complaints cannot be considered in retrospect.

As agents we act for and on behalf of our models and whilst making every endeavour to provide a satisfactory and efficient service we cannot ultimately be held responsible for a model’s conduct on an assignment.
